Privacy Policy

Privacy Policy – Version 1.1
Effective Date: March 1, 2025

1. Introduction

Pacific Open Water Swim Co. (“we,” “us,” or “our”) respect your privacy. This Privacy Policy describes how we collect, use, disclose, and retain personal information across our websites—www.pacificswim.co—and in connection with services, events, communications, and merchandise. This policy is incorporated by reference into our Terms of Service, Terms of Use, Ticket Contract, and Participant Waiver.

2. Information We Collect

We collect the following categories of information:

  • Identifiers: Name, email address, phone number, postal address, country of residence, and emergency contact information.
  • Booking and Transaction Data: Swim registration, clinic enrollment, merchandise purchase history, and payment status (note: we do not collect or store credit card numbers).
  • Health-Related Disclosures: Voluntary disclosures related to mobility, limitations, or safety considerations necessary for open water swim participation.
  • Device and Usage Information: IP address, browser type, referring pages, location (if shared), and interactions with our site or forms.
  • Communication Records: Inquiries, emails, customer service messages, or consent forms.
  • Audio/Visual Data: Photographs, videos, or recordings captured at events, swims, or training sessions, where applicable.

3. How We Use Information

We use the data described above to:

  • Provide, schedule, and support our open water swimming services.
  • Confirm, update, or coordinate your event registration and safety information.
  • Communicate with you about your booking, safety briefings, schedule changes, or policies.
  • Process merchandise orders and handle service-related requests.
  • Comply with our legal obligations, including safety documentation and participant recordkeeping.
  • Improve website function, usability, and customer experience through analytics.
  • Enforce our Terms of Service, Ticket Contract, Waiver, and Swim Rules.
  • Provide safety coordination and incident response, where necessary.

4. Analytics, Cookies, and Tracking

We use cookies, scripts, and tracking tools, including but not limited to:

  • Google Analytics
  • Meta/Facebook tracking pixels
  • Session tracking via embedded third-party tools (e.g., Cognito Forms, Calendly)
  • These tools may track behavior across sessions and domains and may constitute “sharing” under California law. We do not serve personalized ads. You can opt out of cross-site tracking through browser settings or tools such as the Google Analytics Opt-out Add-on.

5. Disclosure of Information

  • We do not sell personal information. We may disclose your data:
  • To third-party processors, including payment vendors, booking platforms, email services, and analytics providers.
  • To affiliated entities, including Altos Pacific, LLC (dba Pacific Open Water Swim Co.), Swim Tahoe LLC, and SwimAlcatraz.com.
  • To official agencies or emergency responders when safety or regulatory obligations require it.
  • As part of a business transition, such as a merger, transfer, or reorganization.
  • When required by law, subpoena, or valid legal process.

6. Data Retention and Archiving

We retain personal data for up to 10 years, or longer if required to:

  • Fulfill our legal obligations or enforce agreements
  • Retain incident reports or safety documentation
  • Maintain registration and booking history

We do not guarantee automatic deletion of data. Requests for deletion under CCPA/CPRA are honored unless legally exempt (e.g., public safety, contractual obligations).

7. Your California Privacy Rights

If you reside in California, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • Right to Know: Access specific categories and data we hold about you.
  • Right to Delete: Request deletion of your personal information (subject to limitations).
  • Right to Correct: Request corrections to inaccurate information.
  • Right to Opt-Out: Request that we do not share your personal information across third-party platforms for behavioral analytics.
  • Right to Non-Discrimination: You will not be penalized or denied service for exercising your privacy rights.

8. Security

We use administrative, technical, and physical safeguards to protect your data. These include:

  • Contractual confidentiality obligations for vendors

However, no data transmission over the internet can be guaranteed to be 100% secure. You assume all risk in transmitting data to us.

9. Children’s Privacy

We do not knowingly collect or solicit data from individuals under the age of 13. If we become aware that such data has been collected, we will delete it.

10. Third-Party Sites and Tools

Our site may include links, embeds, or integration with third-party tools (e.g., YouTube, MapBox, Zoom). Your use of those tools is governed by their respective privacy policies. We are not responsible for their content or behavior.

11. Changes to This Privacy Policy

13. Legal Integration Note

This Privacy Policy incorporates by reference all liability and risk disclaimers set forth in our Participant Waiver, Ticket Contract, Terms of Service, and Swim Rules. In the event of a conflict, those documents shall control for purposes of risk assumption, liability limitation, and dispute resolution.
